Terms of Service

These Terms of Service (“Terms”) govern your use of the Focusmeter mobile app for Android, the website at focusmeter.app, and any related services (together, the “Service”), operated by Focusmeter (“Focusmeter”, “we”, “us”).
1. Acceptance and scope
By accessing or using any part of the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service, or older where your local law requires a higher minimum age.
3. License to use Focusmeter
We grant you a limited, revocable, non-transferable, non-exclusive license to use the Service for personal, non-commercial productivity purposes. You may not reverse engineer, decompile, copy (except as the Service normally allows), resell, scrape, or attempt to circumvent any limits or security of the Service.
4. Your content and data
Your focus sessions, timer settings, and other data you enter are stored locally on your device. Focusmeter does not currently store this data on its servers. You are responsible for maintaining your own backups.
5. Subscriptions and payments (Focusmeter Pro)
Focusmeter offers a paid subscription billed through Google (Google Play). Your subscription automatically renews for the same period at the then-current price unless you cancel it at least 24 hours before the end of the current period. The subscription unlocks the premium features described in the app. You can manage or cancel your subscription, and review the price and billing period, in your Google Play account settings. Refunds are governed by Google Play’s policy.
6. Acceptable use
You agree not to use the Service for any unlawful purpose, to interfere with or disrupt the Service, or to gain unauthorised access to any system or data.
7. Service availability and changes
The Service is provided “as is” and “as available”. We may modify, suspend, or discontinue any feature at any time.
8. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, Focusmeter and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of or inability to use the Service, even if advised of the possibility of such damages.
10. Indemnification
You agree to indemnify and hold Focusmeter harmless from any claim or demand arising out of your violation of these Terms or your misuse of the Service.
11. App-store terms (Google Play)
- These Terms are between you and Focusmeter only, and not with Google.
- Focusmeter, not Google, is solely responsible for the app and its content, and for providing any maintenance and support.
- Focusmeter, not Google, is responsible for any product warranties and for addressing any claims relating to the app, including product-liability and intellectual-property-infringement claims.
- You represent that you are not located in a country subject to a U.S. Government embargo and that you are not on any U.S. Government list of prohibited or restricted parties.
12. Termination
You may stop using the Service at any time by uninstalling the app. We may suspend or terminate your access if you violate these Terms.
13. Changes to these terms
We may revise these Terms from time to time. For material changes we will surface a notice in the app or on the website. Your continued use of the Service after a change means you accept the current version.
14. General
If any provision of these Terms is held unenforceable, the rest remain in effect. These Terms are the entire agreement between you and Focusmeter regarding the Service. Our failure to enforce any provision is not a waiver.
15. Governing law and disputes
These Terms are governed by the laws of Singapore, and you submit to the exclusive jurisdiction of the courts of Singapore.
